Terms & Conditions

These terms and conditions ("Terms") govern your use of the services provided by Wexicon ("Wexicon," "we," or "us"), including but not limited to the website, domain services, design services, hosting services, and any other related services (collectively referred to as the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Account Registration

1.1 You may need to create an account with Wexicon to access certain Services. By creating an account, you agree to provide accurate, current, and complete information and to update such information as necessary to maintain its accuracy.

1.2 You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Wexicon immediately of any unauthorized use of your account or any other breach of security.

2. Services

2.1 Wexicon provides a platform for individuals and businesses to create and manage their digital real estate, including but not limited to personal websites, CV websites, and professional online identities.

2.2 Wexicon offers domain services, design services, hosting services, SSL certificate installation, resume design services, update credits, and professional email services as part of its Services.
2.3 Wexicon offers domain name procurement services as part of its plans. Please note the following disclaimers regarding domain names:

2.3.1 Domain Name Selection: Wexicon shall procure a domain name not exceeding $20 for each user. The selection of the domain name is at the discretion of Wexicon and is subject to availability.

2.3.2 Closest Match: The chosen domain name will be the closest match to an individual's name, subject to availability and Wexicon's internal guidelines.

2.3.3 Domain Name Extension: The registration of the domain name extension follows a protocol as per Wexicon's internal rules and regulations.

2.3.4Authority: Wexicon retains absolute authority over the selection and registration of domain names for its users.

3. Intellectual Property

3.1 All rights to the design of the websites created using Wexicon's Services are held by Wexicon. You may not reproduce, distribute, or create derivative works based on the design without prior written permission from Wexicon.

3.2 Any content uploaded or submitted by you through the Services remains your intellectual property. However, by uploading or submitting such content, you grant Wexicon a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for the purpose of providing the Services.

4. Payment

4.1 You agree to pay all fees and charges associated with your use of the Services in accordance with the pricing and payment terms provided by Wexicon. All fees are non-refundable unless otherwise specified by Wexicon.

4.2 Wexicon reserves the right to change its fees and pricing at any time, with or without notice. Any changes to fees or pricing will be effective immediately upon posting on the Wexicon website.

5. Privacy

5.1 Wexicon values your privacy and collects, uses, and protects your personal information in accordance with its Privacy Policy. By using the Services, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

6. Limitation of Liability

6.1 To the fullest extent permitted by law, Wexicon and its affiliates, officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • your access to or use of or inability to access or use the Services;

  • any conduct or content of any third party on the Services;

  • any content obtained from the Services; or

  • unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. Indemnification

7.1 You agree to indemnify and hold harmless Wexicon and its affiliates, officers, directors, employees, agents, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

  • your use of the Services;

  • your violation of these Terms;

  • your violation of any rights of any third party; or

  • any other matter relating to the Services.

8. Termination

8.1 Wexicon may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

9. Governing Law

9.1 These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles.

10. Changes to Terms

10.1 Wexicon reserves the right to modify or replace these Terms at any time, with or without notice. Any changes to these Terms will be effective immediately upon posting on the Wexicon website. You are responsible for regularly reviewing these Terms.
